Could Lead to More Settlements
By Paul Boynton
Potential legal effects of the recent U.S. Supreme Court decision in State Farm Mutual Automobile Insurance Co. v. Campbell on what constitutes excessive punitive damages. The experts consulted disagreed as to whether the ruling could lead to more defendants willing to go to court and, when necessary, appealing adverse decisions or whether the courts definition of what it considered excessive still allowed the possibility of awards big enough to push defendants to the settlement table. Opinions also varied as to whether the prospect of more limited punitive damages awards would affect settlement negotiations at all. The article also discusses strategies that plaintiffs lawyers are developing to circumvent the State Farm ruling such as focusing on language in the decision that may make it possible for them to distinguish the case from personal injury cases.
